Theme Park accidents are virtually identical to
slip and fall cases except that they are against theme park owners
such as Walt Disney World and Universal Studios. With the millions
of visitors that come to Orlando area theme parks, the theme parks
feel they have no choice but to fight each and every one of these
claims. Therefore, you should not be surprised that when you follow
up with the claims department upon your arrival back home that your
claim is denied. The claims department may request a release for
them to obtain all your medical records and other background information.
You should hesitate to release this information without first consulting
an attorney.
In
these cases, documentation of the condition that caused the injury
is critical. While injury on a ride may be difficult to document,
other dangerous conditions such as broken devices or foreign substances
or defects inroads and sidewalks can be documented by photographic
evidence and you should endeavor, if possible, to take pictures
of these conditions. It is also important, if possible, to obtain
the names and phone numbers of any witnesses and Theme Park employees
who saw the incident and/or rendered aid. The theme parks are very
good at repairing and/or rectifying the conditions that caused any
injury immediately after it occurred. Fortunately, most visitors
to the Orlando area theme parks have cameras with them and this
makes obtaining pictures of any dangerous condition much easier.
